1. Acceptance of Terms

By accessing or using ApplicantSpace ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

These terms constitute a legally binding agreement between you and Next Chapter Skills Private Limited, a company incorporated under the laws of India.

2. Description of Service

ApplicantSpace is an AI-powered resume tailoring platform that helps job seekers create customised, keyword-optimised resume versions for specific job applications. The Service includes:

• A master resume builder for storing your professional profile
• AI-powered resume tailoring based on job descriptions you provide
• Match scoring, red flag analysis, and a translation log of AI changes
• Application tracking functionality
• A Chrome Extension for job description capture
• PDF export of tailored resumes

The Service is currently available on an invite-only basis during our private pilot. Access may be extended, modified, or restricted at our discretion.

3. Account Registration & Pilot Access

3.1 Eligibility

You must be at least 16 years of age to use ApplicantSpace. By using the Service, you represent that you meet this requirement.

3.2 Pilot Access

During the pilot phase, access to ApplicantSpace requires an invitation from a founding member or a direct invitation from our team. Founding members may invite up to 5 people during the pilot period. Invitation slots are non-transferable.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and to keep this information updated. You are responsible for maintaining the confidentiality of your login credentials.

3.4 One Account Per Person

Each person may hold only one account. Creating multiple accounts to circumvent access restrictions or usage limits is not permitted.

4. Trial Period & Billing

4.1 Free Trial

Invited users receive 30 days of free access to the full Service with no credit card required. The trial begins on the date your account is created.

4.2 Post-Trial Access

After your trial period ends, continued access requires a paid subscription at $25 USD per month (or the then-current published price). We will contact you personally before your trial expires to discuss continued access. There are no automatic charges without your explicit consent.

4.3 Founding Members

Certain accounts designated as "Founding Members" by our team receive lifetime access to the Service at no charge. This designation is at our sole discretion and may be modified with reasonable notice.

5. Acceptable Use

5.1 Permitted Use

You may use ApplicantSpace for lawful, personal job-seeking activities. You may create, tailor, and export resumes for your own job applications.

5.2 Prohibited Conduct

You agree not to:

• Use the Service to create resumes for other people for commercial purposes without our written permission
• Use automated scripts, bots, or scrapers to interact with the Service
• Attempt to reverse-engineer, decompile, or extract our AI prompts or proprietary algorithms
• Use the Service to generate false or misleading resume content that misrepresents your qualifications
• Upload content that violates third-party intellectual property rights
• Attempt to gain unauthorised access to other users' accounts or data
• Use the Service in any way that violates applicable Indian law or the laws of your jurisdiction
• Resell, sublicense, or redistribute the Service without authorisation
• Abuse the referral/invite system to create fraudulent accounts

5.3 Usage Limits

We reserve the right to implement internal usage limits to maintain service quality for all users. These limits are set significantly above what a genuine job seeker would require in normal use and will not be prominently advertised, but are in place to prevent abuse.

6. AI-Generated Content Disclaimer

Important: The resume content generated by ApplicantSpace is AI-assisted. While our AI is designed to translate your existing experience accurately, you are solely responsible for reviewing all AI-generated content before submission.

• Do not submit any tailored resume without reviewing it for accuracy
• The AI may occasionally make errors, misinterpret your experience, or include incorrect details
• Any resume you submit to a potential employer represents you — verify that it accurately reflects your qualifications
• We do not guarantee that use of ApplicantSpace will result in interview callbacks or job offers
• We are not responsible for consequences arising from inaccurate AI-generated content that you submit without reviewing

7. Intellectual Property

7.1 Your Content

You retain ownership of all content you upload to ApplicantSpace, including your master resume, job descriptions, and application notes. By using the Service, you grant us a limited licence to process this content solely for the purpose of providing the Service to you.

7.2 Our Intellectual Property

The ApplicantSpace platform, including its design, code, AI systems, scoring algorithms, and "Translation Log" feature, are owned by Next Chapter Skills Private Limited. You may not copy, reproduce, or create derivative works from any part of our platform.

7.3 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation.

8. Third-Party Services

ApplicantSpace uses the following third-party services to deliver its functionality:

• OpenAI — AI processing of resume and job description data. Subject to OpenAI's terms of service.
• Vercel — Hosting and infrastructure. Subject to Vercel's terms of service.

We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of ApplicantSpace constitutes acceptance that your data may be processed by these services as described in our Privacy Policy.

9. Disclaimers & Limitation of Liability

9.1 Service Provided "As Is"

ApplicantSpace is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Guarantee of Outcomes

We make no guarantee that using ApplicantSpace will result in job interviews, employment offers, or any specific outcome. Career outcomes depend on many factors outside our control.

9.3 Limitation of Liability

To the fullest extent permitted by applicable law, Next Chapter Skills Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim (or INR 1,000 if you paid nothing).

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, abuse the Service, or for any other reason at our discretion, with or without notice.

You may delete your account at any time by emailing admin@applicantspace.com. Upon account deletion, your data will be permanently removed within 30 days.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

Before pursuing formal legal action, we encourage you to contact us at admin@applicantspace.com to resolve any issue informally.

12. Changes to These Terms

We may update these Terms from time to time. We will notify active users by email of material changes at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
